This document includes three sections: one for militaria and related items, one for vehicles and related items, and a general Terms and Conditions section.
Vehicles
Conditions of Sale for Vehicles
- All vehicles are sold as described in the advertisement or as communicated in person.
- For vehicles, such as World War II models, replica parts may be used. We strive to provide as much information as possible about any reproduction parts, but errors may occur.
- We do not offer guarantees for the mechanical components of a vehicle, including the transmission, engine, gearbox, body, and gauges. Please be aware that parts of any vehicle may break down at any time. We ensure that the vehicle is in good drivable condition before the sale unless otherwise specified in the sales agreement.
Returns
Once a deal is finalized and the vehicle is picked up, returns are not accepted. If you encounter issues or are dissatisfied, please contact us, and we will try to assist you.
Contract Agreement
- BYF41 will provide an invoice to the buyer.
- Both parties must sign a sales agreement provided by BYF41.
Payments and Reservations
- Vehicles can be reserved for three days without a down payment.
- For reservations longer than three days, a 10% deposit is required.
- Full payment is expected within 30 days after the deal is agreed upon. If the buyer cancels the deal, we will retain 35% of the upfront payment to cover expenses.
Guarantees
- We guarantee that all vehicles delivered in the Netherlands can obtain a Dutch license plate. If the license plate is revoked, BYF41 will refund the full amount as per the invoice, provided the vehicle is returned in its original state.
- Note: Any expenses incurred by the buyer on the vehicle or license plate will not be refunded.
Transport of Vehicle
Vehicle transport is at the buyer’s risk. Although all our transports are insured, we cannot guarantee a full refund in case of an accident.
Storage
- Storage at BYF41 is at the owner’s risk.
- Storage is free for consignment sales.
- After an agreement is reached on a vehicle, a pickup date will be set. The first two weeks of storage are free; after that, BYF41 charges €30 (excluding taxes) per week per m² the vehicle occupies.
Spare Parts
- We stand by the quality of our spare parts. If a part arrives damaged, the buyer may return it within 14 days for a full refund or replacement.
- Conditions: The part must be in the original condition, including the factory packaging. If there is doubt about its condition, BYF41 reserves the right to deny a refund or replacement.
Shipping of Parts
- We offer insured and uninsured shipping options.
- If a package is damaged or lost without insurance, we will assist to the best of our ability but cannot offer a full refund.
- If a package with insurance is damaged or lost, we will issue a full refund (when fully insured) within 30 days.
- Refunds are not available if shipping details are incorrect or if the package is lost after being signed for.
Consignment Sale
- We offer consignment sales with clear rules and agreements.
- The owner may publicly offer their vehicle or sell it independently.
- The owner cannot offer the vehicle for a lower price to a third party during the agreed sale period. If the vehicle is offered or sold for a lower price by the owner, the agreement will be terminated, and a €1,500 fee (excluding taxes) will be charged for BYF41’s work.
Buying at Your Location
We do understand the issue of free time and spending a day in the car towards our storage to take a look at a vehicle;
We can deliver vehicles to your location for shipping costs only for inspection. You are able to inspect the vehicle before making a purchase decision. If you decide not to proceed, you only pay the shipping costs for delivery and return.
Note: Full payment is required before unloading the vehicle at your location.
Maintenance
- We offer maintenance for clients’ vehicles and provide detailed invoices for all work and parts.
- For longer projects, we send weekly invoices and continue work upon payment.
- We provide a limited 7-day or 20-mile warranty on our work. In case of errors on our part, BYF41 will cover the cost of repairs.
Payment Plans
- Payment plans are available for expensive collectables. A 10% down payment and a 10% non-refundable fee apply if the deal is canceled.
- The purchased item will be shipped once the payment is completed.
Photography and Intellectual Property
- All photographs on our website are the property of BYF41 and may not be used without prior permission
Additional Services
Vehicle Sourcing and Consultation
If you would like our assistance in finding your ideal vehicle, contact us. We can locate and inspect vehicles on your behalf.
If a deal is finalized after BYF41’s involvement, but the buyer attempts to bypass BYF41, the buyer will owe BYF41 a fee equivalent to a minimum of 15 work hours for their expertise and assistance.
BYF41 and the client may agree on an hourly rate or a flat fee for the service.
Militaria & Accessories
Conditions of Sale for Militaria
Provenance information, where available, is included in the listing to provide background and context. However, please note that provenance may vary by item, and not all items come with full historical documentation.
All militaria offered on our website is guaranteed to be in 100% original condition. We carefully verify the authenticity of each item before listing it for sale to ensure its historical integrity and collector value.
Detailed descriptions and photographs are provided to give an accurate representation of each item. We encourage potential buyers to review all information carefully and reach out with any questions before purchasing.
Due to the unique nature of militaria items, variations in condition are to be expected. While we highlight any known imperfections, normal wear consistent with the item’s age and history is part of its authenticity.
Payment Plan
- We offer payment plans for high-value collectables, understanding that these items may require significant savings.
- A 10% down payment is required, along with a non-refundable 10% fee if the deal is canceled.
- Purchased items will be shipped once the full payment is completed.
Conditions of Sale for Militaria Items
Postage charges will be calculated based on package weight, location, and preferred shipping method. Items are shipped at the customer’s risk; we recommend using insured shipping.
Items may be returned for a full refund, provided they are returned in the same condition as sent.
Items must be returned within 14 days (Europe) if you are not completely satisfied, for any reason other than outlined in point 1.
Items purchased at fairs are non-returnable.
